Terms of Service

1. Acceptance of Terms

By accessing or using the Turn Up platform, website, and mobile applications (collectively, the “Service”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. Turn Up reserves the right to update these terms at any time, and your continued use constitutes acceptance of any changes.

2. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account credentials
• Accept responsibility for all activity under your account
• Notify Turn Up immediately of any unauthorized use

You must be at least 18 years old to create an account. Turn Up reserves the right to suspend or terminate accounts that violate these terms.

3. Ticket Purchases

When you purchase tickets through Turn Up, you agree to the following:

• All ticket sales are final unless otherwise stated by the event organizer
• Ticket prices are set by event organizers and may include service fees
• You are purchasing a limited, non-transferable license to attend the event unless the organizer permits transfers
• Turn Up acts as a marketplace and is not the organizer of third-party events
• Duplicate, counterfeit, or fraudulently obtained tickets will be void

4. Refund Policy

Refund policies are determined by individual event organizers. As a general framework:

• Refund requests must be directed to the event organizer through the platform
• If an event is cancelled by the organizer, ticket holders are entitled to a full refund
• If an event is postponed, tickets remain valid for the rescheduled date; refunds may be requested within 14 days of the announcement
• Service fees may be non-refundable depending on the circumstances
• Turn Up will facilitate refunds but is not liable for organizer refund disputes

5. Event Organizers

If you use Turn Up to host events, you additionally agree to:

• Provide accurate event details including date, time, venue, and pricing
• Honor all tickets sold through the platform
• Comply with all applicable local laws, permits, and venue regulations
• Not use the platform to promote illegal activities or discriminatory events
• Turn Up may collect a service fee or commission on ticket sales as outlined in your organizer agreement

6. User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Post false, misleading, or deceptive event listings
• Harass, threaten, or abuse other users
• Scrape, crawl, or use automated tools to access the Service without permission
• Attempt to circumvent security measures or interfere with the platform's operation
• Resell tickets at inflated prices (scalping) unless explicitly permitted by the organizer
• Impersonate another person or entity

7. Intellectual Property

The Turn Up name, logo, and all related marks, designs, and content are the property of Turn Up and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without express written permission. Event organizers retain ownership of their event content but grant Turn Up a license to display and promote it on the platform.

8. Limitation of Liability

To the fullest extent permitted by law:

• Turn Up is provided “as is” without warranties of any kind, express or implied
• Turn Up is not liable for the actions of event organizers, venues, or attendees
• Turn Up shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid to Turn Up in the 12 months preceding the claim
• Turn Up is not responsible for event cancellations, changes, or the quality of events

9. Indemnification

You agree to indemnify and hold harmless Turn Up, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these terms, or your violation of any rights of a third party.

10. Termination

Turn Up may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, limitation of liability, and indemnification survive termination.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Turn Up operates, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved through binding arbitration, unless otherwise required by applicable law.
